The Treasury Department recently introduced a new draft law on an updated fiscal policy that would raise the salaries of officials to the level set by the president back in 2012. Against the background of such a statement, a completely natural question arises whether there will be an increase in the salaries of prosecutors in 2018, because they also refer to budget employees, whose income is financed by the state treasury.

The draft law on professional development gives an excellent chance to self-taught people who independently study the basics of the profession, but are not holders of the appropriate education and a document that can be presented when applying for a job. Exams are taken voluntarily, and a certain fee is required for this service (either from the person personally or from his employer). The absence of a certificate has no consequences, it is simply an additional tool to increase the demand for a specialist among employers.
How does this draft law relate to prosecutors? Frankly speaking, the news that there will be an increase in the salary of prosecutors in 2018 is rather ambiguous, because according to the law signed by the president back in the 12th year, the event should happen, but frankly, there is no funds in the financial budget to fulfill obligations spelled out in bills. Experts say that members of the government will do everything to fulfill the presidential decrees, because the next presidential elections are scheduled for this very year, and it is in the interests of the authorities that all their promises are now fulfilled.
However, indexing the salaries of prosecutors for 2018 is probably the only available means of increasing the salaries of prosecutors. Frankly speaking, the representatives of the prosecutor's office need not complain, because they can boast of already impressive salaries, but they, like all budgets, also counted on an increase in income. The current budget does not have enough funds to increase the salaries of prosecutors, therefore, even in the latest news, no specific information has yet been provided on this matter, however, after the adoption of the budget, the situation may change, so it is worth keeping an eye on it.

Are there any cuts expected?

Sources of "Kommersant" said that preparations for the reform began after the president of the country, by his decrees, liquidated and, whose functions were transferred. At the same time, the Russian Guard was created.

According to sources, now it comes on the actual return of the FSB to the functions of the USSR State Security Committee. The new structure, the Ministry of State Security, will admit most divisions. The current version of the FSO will remain in the form, it will control special communications and transport services for senior officials.

The new ministry, in addition to structural changes, will receive new functions. It is assumed that the MGB officers will not only accompany and ensure the investigation of criminal cases initiated on the basis of their materials by the TFR and the Ministry of Internal Affairs, but will exercise procedural supervision over them. Previously, these functions were performed by the main department of procedural control of the TFR, which has now been virtually eliminated. In addition, the new ministry will ensure its own security in all law enforcement and security structures.

The Investigation Department of the MGB, which will have the status of the head office, will take into its proceedings the most resonant and state-significant criminal cases, the jurisdiction of which is now assigned in the Criminal Procedure Code to the TFR and the Ministry of Internal Affairs.

The new investigation scheme is already being rolled out, the sources say. So, it was the FSB that opened a criminal case on the organization of a criminal community against the thief in law Zakhary Kalashov (Shakro Molodoy) and his associates, although the corresponding Art. 210 of the Criminal Code of the Russian Federation does not apply to her jurisdiction. At the same time, other departments deal with episodes of alleged crimes committed by the organized criminal community.

"If earlier we (FSB operatives - ed.) Carried out only support of investigations, now we are tasked with monitoring their progress from the moment of initiation of criminal cases to their transfer to court," an informed source in the FSB told Kommersant that this is about high-profile cases, including corruption.

He clarified that the Chekists will also check how effectively and in full measure the investigator used the information provided to him by the special service. At the same time, in what form such control will be carried out is still not completely clear.

In Russia, serious changes can also occur in the course of the reform. The TFR, in particular, may again become a structure attached to the country from which it was separated in 2011. In this case, the status of its headquarters will be downgraded. For example, the main military investigation department is supposed to be made a regular department. At the same time, from January 1, 2017, the main military prosecutor's office of Russia will become the office of the Prosecutor General's Office. The law on this was adopted back in 2014 due to the fact that the military investigation and supervision over it will no longer be funded from the budgets of the Ministry of Defense, the Ministry of Internal Affairs and the FSB.

The Ministry of Defense can strengthen it by including troops in its composition. civil defense, as well as rescue, fire and other services of the Ministry of Emergency Situations. The Ministry of Internal Affairs will leave the disbanded ministry with Gospozhnadzor, which was previously in its structure.

The reform of the power and law enforcement agencies will be completed by 2018. For this, however, it is necessary to prepare bills and adopt them by the new composition of parliament, as well as find funds for changes. By the most conservative estimates, tens of billions of rubles will be required to pay compensation to employees of the reformed departments who do not want to serve in the new structures.

Sources of the publication note that in the process of the proposed reform it is planned to replace the current heads of services and departments. One of them is called the creator of the TFR, who has allegedly been "given to understand that in the new structure he can only count on an honorary position, but devoid of managerial powers."

The government submitted to the State Duma a bill on the annual indexation of pensions for retired employees of the Investigative Committee of Russia (TFR) and prosecutors. The document was registered with the chairman of the lower chamber Vyacheslav Volodin on October 25 and published in its database.

The document proposes amendments to the laws "On the Prosecutor's Office" and "On the Investigative Committee." Last time pensions for retired investigators and prosecutors were increased in 2014 - this happened with an increase in the pay of the relevant authorities, according to the explanatory note to the project. Former employees of the TFR and the prosecutor's office are provided with a pension on the same principle as retired military personnel, employees of the internal affairs bodies, the penal system and the National Guard. However, the abovementioned employees' pensions increase annually, but not for the employees of the TFR and the prosecutor's office, the document says.

Pensions for military personnel are growing due to an increase in the percentage of monetary allowances, to which pensions are equated: since 2012, it has grown from 54 to 72.23%.

According to the current legislation, the official salaries of prosecutors and ICR employees are calculated based on the salaries of judges, which have not been indexed since 2015. Starting from 2018, the government and other categories of civil servants, as well as the allowances of the military - from January 1, these payments will be indexed by 4% and then by the same amount in 2019 and 2020. The project also proposes to index the monthly allowance to the pension of the ICR and the prosecutor's office employees.

The government's initiative “is necessary and deserves support,” said Vasily Piskarev, head of the State Duma’s Security and Anti-Corruption Committee (“ United Russia"). “The legislation provides for the possibility of annual indexation of pensions for retired employees of the prosecutor's office and the Investigative Committee, by analogy with the existing indexation of pensions for citizens dismissed from military and equivalent service. Thus, some inequality in pension provision will be eliminated, ”he told RBC.

Now, pensions for prosecutors and employees of the Investigative Committee who were dismissed from service are paid for at least 20 years of service. They make up 50% of their pay, which includes an official salary and a monthly seniority bonus. The salaries of ordinary prosecutors constitute a certain percentage of the salary of the first deputy prosecutor general; the salaries of investigators in the same way depend on the salary of the first deputy chairman of the TFR. In turn, the salaries of the heads of these departments are tied to the salary of the chairman of the Supreme Court.

The increase in payments will require additional expenditures from the budget in the amount of 2.5 billion rubles in 2018, the authors of the project calculated. In 2019 and 2020, the costs will exceed the planned by 3.1 billion rubles. Such amounts are provided for in the current law on the federal budget, the bill emphasizes.

At the same time, for each individual retired investigator or prosecutor, the increase is unlikely to be significant. Thus, a retired investigator for special important matters the regional investigation department receives about 20 thousand rubles a month, the central office - about 30 thousand rubles.
