Vasily Chuikov graduated from the Frunze Military Academy, took mechanization and motorization courses at this academy, studied brilliantly at the Oriental Faculty, which allowed him to make not only a military, but also a diplomatic career.

He had to practice on one of the most difficult sections of the diplomatic front - in China. From 1940 to 1942, Vasily Chuikov was a military attache under the commander-in-chief of the Chinese army, Chiang Kai-shek.

China at that time not only fought against Japanese aggression, but also experienced internal strife - between the army of the Communist Party of China, commanded by Mao Zedong, and the army of Cha Kai-shek. Thanks to his versatile talent in military, diplomatic and intelligence matters, Chuikov managed to change the situation in China and help create a united front in the Celestial Empire that defended the Far Eastern borders of the USSR from Japanese aggressors.

Even before serving as a military attache under Chiang Kai-shek, Vasily Chuikov, as commander of the 9th Army, participated in the liberation campaign of the Red Army in 1939 and in the Finnish War. He later called it the most terrible military campaign in which he had a chance to take part. According to the marshal's memoirs, reinforcements were brought to the front from southern Ukraine. The recruits, who could not even stand on skis, had to fight with experienced Finnish units. Chuikov recalled that because of a large number gangrenous and frostbite around infirmaries in Finnish war there was such a stench that it carried for several kilometers.

Vasily Chuikov paid great attention to the manifestation of personal initiative by each soldier, he insisted that Stalingrad could not be surrendered until at least one soviet soldier alive. Chuikov took the liberty of moving away from stereotyped schemes in the art of war and won. P.N.A. (Plaintiff) filed a lawsuit against the Department of Social Development of Khanty-Mansi Autonomous Okrug - Yugra (Defendant) to declare illegal the refusal to confer the title of "Veteran of Labor", the obligation to confer the title of "Veteran of Labor".

The requirements were motivated by the fact that she was denied this title on the grounds that the Medal "Marshal Vasily Chuikov" was not included in the list of awards approved by the Decree of the Government of the Autonomous Okrug dated 06.06.2005 No. 103-p. The plaintiff asked to recognize the refusal as illegal and to impose on the defendant the obligation to confer on her the title of "Veteran of Labour".

She believed that the defendant's refusal violated her rights and interests to receive social guarantees to persons to the category of which she belongs by virtue of the law of the Russian Federation. She asked to recognize the refusal as unlawful and to impose on the defendant the obligation to confer a title on her.

The defendant did not agree with the claim, submitted written objections, in which he referred to the fact that the plaintiff's award was not included in the List of awards approved by the Okrug Government, in the presence of which, in accordance with the law of the subject of KhMAO-Yugra, such a title is awarded. Therefore, the plaintiff's rights were not violated by the refusal to confer the title.

The persons involved in the case did not appear at the hearing.

The court verified the arguments of the parties, the evidence presented, ruled the above decision, the repeal of which in the appeal is requested by the defendant Department of Social Development of the Khanty-Mansiysk Autonomous Okrug - Ugra. Refers to the circumstances established during the consideration of the case.

In the appeal, the Department of Social Development of the Khanty-Mansiysk Autonomous Okrug - Yugra raises the issue of canceling the court decision and making a new decision in the case, taking into account the arguments of the appeal. Since the measures of social support for labor veterans are determined by laws and other regulatory legal acts of the constituent entities of the Russian Federation and are their expenditure obligations, the constituent entities of the Russian Federation have the right to independently determine the list of awards taken into account when conferring the title "Veteran of Labor" in the constituent entity of the Russian Federation. The court's reference to the fact that the legislator of the constituent entity of the Russian Federation is not entitled to narrow the list of persons belonging to the category of labor veterans in accordance with Article 7 of the Federal Law "On Veterans", believes that it is untenable, since Decree of the Government of the Autonomous Okrug dated June 6, 2005 No. 103- n, does not exclude persons awarded departmental insignia in labor, but defines a list of departmental insignia.

The persons participating in the case, notified of the time and place of the consideration of the case in the court of appeal, did not appear at the court session, did not report the reasons for the absence to the court, and therefore, on the basis of Articles 327, 167 of the Code of Civil Procedure Russian Federation the judicial board finds it possible to consider the case in their absence.

After checking the case file, discussing the arguments of the appeal, the judicial board finds that the court's decision complies with the evidence in the case and the requirements of the law.

The court of appeal considers the case within the limits of the arguments set forth in the appeal, presentation and objections to the complaint, presentation (clause 1, article 327.1 of the Code of Civil Procedure of the Russian Federation).

The court, having checked the arguments and evidence presented by the parties, proceeded from the fact that, in accordance with Part 2 of Article 7 of the Constitution of the Russian Federation, the Russian Federation ensures governmental support families, motherhood, fatherhood and childhood, disabled and elderly citizens, a system of social services is being developed, state pensions, benefits and other guarantees of social protection are being established.

According to paragraph "g" of Part 1 of Article 72 of the Constitution of the Russian Federation, issues of social protection of the population are in the joint jurisdiction of the Russian Federation and the constituent entities of the Russian Federation.

According to the meaning of the above constitutional provisions in their interconnection, the social function of the state is assigned by the Constitution of the Russian Federation both to the Russian Federation as a whole and to each of the constituent entities of the Russian Federation. Accordingly, the state authorities of both territorial levels of power are called upon to jointly provide effective mechanisms for the social protection of citizens.

Participation of the subjects of the Russian Federation in the implementation social function of the state through the adoption of legislative decisions in the field of social protection of citizens, should be based on the constitutional delineation of jurisdiction and powers between the Russian Federation and the constituent entities of the Russian Federation and the constitutional hierarchy of normative legal acts, and also comply with the principles arising from the Constitution of the Russian Federation that underlie social security , including the principles of justice, equality, stability of the legal status of subjects of social rights.

In accordance with Article 7 of the Federal Law of January 12, 1995 No. 5-FZ (as amended on November 16, 2011) “On Veterans”, labor veterans are persons:

1) having a certificate "Veteran of Labor";

2) awarded with orders or medals, or awarded honorary titles of the USSR or the Russian Federation, or awarded departmental insignia in labor and having the length of service necessary for the appointment of an old-age or long service pension; persons who started labor activity underage during the Great Patriotic War and having a work experience of at least 40 years for men and 35 years for women.

The procedure and conditions for conferring the title of "Veteran of Labor" are determined by laws and other regulatory legal acts of the constituent entities of the Russian Federation.

Decree of the President of the Russian Federation of September 25, 1999 N 1270 (lost force on June 12, 2006 in connection with the issuance of Decree of the President of the Russian Federation of June 12, 2006 N 603) approved the Regulations on the procedure and conditions for conferring the title of "Veteran of Labour", which also did not establish any restrictions on the legal status of persons assigned to this category.

Federal Law No. 122-FZ of August 22, 2004 “On Amending the Legislative Acts of the Russian Federation and Recognizing Some Legislative Acts of the Russian Federation as Invalid in Connection with the Adoption of the Federal Laws “On Amendments and Additions to the Federal Law “On general principles organizations of legislative (representative) and executive bodies of the Government of the Subjects of the Russian Federation” and “On the General Principles of Organization of Local Self-Government in the Russian Federation”, amendments were made to the Federal Law “On Veterans”, in accordance with Article 22 of which measures of social support for labor veterans, as well as citizens equated to them as of December 31, 2004, determined by the laws and other regulatory legal acts of the constituent entities of the Russian Federation.

Art. 7 of the Federal Law "On Veterans" are limited only to the basic requirements in determining the grounds for acquiring the status of a labor veteran, thus forming the direction of the legislative process of the regions in this area. However, within the meaning of this federal norm, the procedure and conditions for conferring the title "Veteran of Labor" means the organizational and legal mechanism for implementation (the procedural grounds for conferring the title "Veteran of Labor", the list of documents required for recognizing persons as labor veterans, the procedure for making a decision, issuing a certificate Veteran of Labour) awarding the title "Veteran of Labour" in accordance with the requirements of Part 1 of this Article, the list of which is exhaustive.

Acting as normative act direct action, Law N 122-FZ provides that in order to protect the rights and legitimate interests of citizens applying for the title of "Veteran of Labour", the laws and other regulatory legal acts of the constituent entities of the Russian Federation cannot establish the grounds and conditions for conferring this title, which significantly worsen the rights and the interests of citizens in comparison with the Law N 5-FZ. The list of orders, medals, honorary titles, the awarding of which acts as a condition for acquiring the status of a labor veteran, as well as the conditions and procedure for awarding are determined by the Regulations on state awards ah of the Russian Federation, approved by Decree of the President of the Russian Federation of March 2, 1994 N 442 (as amended).

Along with orders and medals, honorary titles of the USSR and the Russian Federation, when conferring the title "Veteran of Labor", departmental insignia in labor are also subject to registration.

The presence of state awards and departmental insignia specified in paragraph 1 of Art. 7 of the Federal Law of 12.01.1995 N 5-ФЗ “On Veterans”, is one of the conditions for conferring the title “Veteran of Labour”, while within the framework of paragraph 4 of Art. 7 of the Federal Law of 12.01.1995 N 5-ФЗ “On Veterans” of powers, the law of a constituent entity of the Russian Federation can independently expand the list of insignia in labor and non-state awards taken into account when conferring the title “Veteran of Labor” in a constituent entity of the Russian Federation.

Satisfying the claims, the court of first instance reasonably came to the conclusion that based on the constitutional principle of equality of citizens' rights, as well as the fact that the plaintiff was awarded the departmental badge of distinction in labor in accordance with the procedure established by law.

Seniority is more than 29 years old, in connection with which, as a person awarded a departmental badge of distinction in labor, the plaintiff belongs to the category of citizens who are labor veterans.

In resolving the dispute, the court correctly determined the legally significant circumstances. The circumstances established by the court are confirmed by the materials of the case and the evidence examined by the court, to which the court gave a proper assessment. The conclusions of the court correspond to the established circumstances. Violations of the norms of procedural and substantive law, entailing the annulment of the decision, were not allowed by the court.

The arguments of the complaint are aimed at a different assessment of the evidence examined by the court of first instance, at a different interpretation of the current legislation, do not contain new circumstances that were not the subject of discussion by the court of first instance or would refute the conclusions of the court decision.

The circumstances of the case have been properly investigated by the court and do not need additional verification. The conclusions of the court are motivated and are supported by the evidence available in the case. The decision of the court meets the requirements of Art. 198 Code of Civil Procedure of the Russian Federation. Substantive law applied by the court correctly. The grounds established by Art. 330 Code of Civil Procedure of the Russian Federation to cancel the judgment was not identified.

It was established in 2012 in honor of twice Hero of the Soviet Union, Head of Civil Defense - Deputy Minister of Defense of the USSR Vasily Ivanovich Chuikov, who has held this post since 1964.

Vasily was born on February 12, 1900 in the village of Serebryanye Prudy, Tula province. He had seven brothers and four sisters, so from early childhood he was accustomed to work. At the age of 12, Vasily went to Petrograd to work, became an apprentice in a spur workshop, and mastered the profession of a locksmith.

With the outbreak of the First World War, all adult men went to the front, only children and the elderly remained to work in the workshop. The demand for spurs was inconsistent - technical progress made itself felt, so in 1917 Vasily Chuikov decided to volunteer for the front and became a cabin boy in the Kronstadt mine training detachment.

In 1918, he became a cadet of the first Moscow military instructor courses of the Red Army, took part in the suppression of the Left-SR rebellion in July. Then Vasily Chuikov took part in the battles in the Civil War. From the age of 19, he already commanded a rifle regiment, fought on the Eastern, Southern and Western fronts, received four wounds during the war, was twice awarded the Order of the Red Banner, a personalized golden weapon and a golden watch.

Vasily Chuikov graduated from the Frunze Military Academy, took mechanization and motorization courses at this academy, studied brilliantly at the Oriental Faculty, which allowed him to make not only a military, but also a diplomatic career.

He had to practice on one of the most difficult sections of the diplomatic front - in China. From 1940 to 1942, Vasily Chuikov was a military attache under the commander-in-chief of the Chinese army, Chiang Kai-shek.

China at that time not only fought against Japanese aggression, but also experienced internal strife - between the army of the Communist Party of China, commanded by Mao Zedong, and the army of Cha Kai-shek. Thanks to his versatile talent in military, diplomatic and intelligence matters, Chuikov managed to change the situation in China and help create a united front in the Celestial Empire that defended the Far Eastern borders of the USSR from Japanese aggressors.

Even before serving as a military attache under Chiang Kai-shek, Vasily Chuikov, as commander of the 9th Army, participated in the liberation campaign of the Red Army in 1939 and in the Finnish War. He later called it the most terrible military campaign in which he had a chance to take part. According to the marshal's memoirs, reinforcements were brought to the front from southern Ukraine. The recruits, who could not even stand on skis, had to fight with experienced Finnish units. Chuikov recalled that due to the large number of gangrenous and frostbitten hospitals around the Finnish war, there was such a stench that it spread for several kilometers.

Vasily Chuikov earned the glory of one of the best military leaders of the Great Patriotic War during the Battle of Stalingrad. At the head of the 64th and then the 62nd Army, Vasily Chuikov did not allow the further advance of the fascist troops to the east. On September 12, 1942, he was given a combat mission to defend the city. Chuikov coped with the task. He personally took part in the battles, more than once he himself flew in reconnaissance in the preparation of military operations. During one of these sorties, the U-2 plane, in which the general was located, was attacked by a German pilot. The U-2 had no weapons and had to maneuver to avoid enemy attacks. As a result, the plane collided with the ground and broke up. Only by a miracle did both the pilot and Vasily Chuikov survive.

During the battles for Stalingrad, Vasily Chuikov introduced melee tactics. He is credited with creating the first mobile assault groups. They consisted of a maximum of 50 people, they included snipers, sappers, chemists, engineers. Vasily Chuikov paid great attention to the manifestation of personal initiative by each soldier, he insisted that Stalingrad could not be surrendered until at least one Soviet soldier was alive. Chuikov took the liberty of moving away from stereotyped schemes in the art of war and won. Hero Vasily Chuikov with his 8th Army reached Berlin, participated in the liberation of Donbass, Zaporozhye, Odessa. At his command post in May 1945, General Helmut Weidling signed the capitulation and surrendered along with the remnants of the garrison.
