1.1. In accordance with this documentation, the State Customer places a state order for the execution of the following types and scope of work:

work on routine repairs of non-residential premises owned by the State Customer: 1. general construction work (replacement of window and door blocks, routine repairs of walls, floors, ceilings, installation of swing bars on windows, etc. ); 2. electrical installation work; 3. plumbing work.

A complete list of work on routine repairs of premises, their scope, requirements, established by the State customer to quality, technical characteristics, safety the above works, etc., are specified in the Technical Specifications of the State Customer and the draft state contract for the performance of work for state needs (Appendices No. 1, 2 to this documentation).

7.2. Justification of the initial (maximum) price of the government contract:

The calculation of the initial contract price is specified in the Local Estimate Calculation, located as part of the State Customer's Technical Specifications;

The source of formation of the initial (maximum) price of the state contract indicated below is the analysis of prices for the work that constitutes the subject of this bidding, carried out by the main manager of federal budget funds - the Federal Bailiff Service (letter FSSP of Russia/VM).

7.3. The initial (maximum) price of the government contract given below takes into account all the Contractor's expenses associated with the proper fulfillment of all obligations assumed under the contract, including the costs of paying taxes, fees, other obligatory payments, the costs of all materials listed in the Technical Specifications instructions of the State Customer, transportation costs, etc.

Answer

The auction is held in electronic form on a special website - an electronic platform. A list of such sites is given in information letter Ministry of Economic Development of Russia. Only participants accredited on the electronic platform chosen by the customer can participate in the electronic auction. When conducting electronic auction The customer must place a notice of purchase at least 7 days before the deadline for submitting applications. Simultaneously with the publication of the notice, place the auction documentation and its attachments on the website: auction information card; technical task; draft contract; justification of the initial (maximum) contract price; application form for participation. Within seven days from the date of publication of the notice, applicants accredited on the electronic platform for concluding a contract submit applications for participation. The application for participation consists of two parts and is submitted in the form of two electronic documents to the operator electronic platform. Within seven days from the deadline for submitting applications, the commission reviews the first parts for compliance with the documentation requirements and draws up a protocol. After two days from the deadline for consideration of the first parts of applications, the operator of the electronic platform conducts an auction. After the auction, the customer reviews the second parts of the participants’ applications within three days and selects the winner. The winner is the participant whose application meets the requirements of the auction documentation and who offered the lowest price. 1. Recommendation: How to conduct an auction electronically

Electronic platforms

The owners of websites where auctions take place electronically must ensure the holding of auctions. The owners of such sites are called operators of electronic platforms. The procedure and conditions for selecting operators are determined by the Government of the Russian Federation. This is stated in Part 4 of Article 59 of the Law of April 5, 2013 No. 44-FZ. Currently, this procedure has not been established by the Government of the Russian Federation.

The list of electronic platforms for conducting electronic auctions was determined earlier by the Ministry of Economic Development of Russia together with the Federal Antimonopoly Service of Russia. This list is given in the protocol of the commission dated January 19, 2010 No. 95 (posted on the official website of the Ministry of Economic Development of Russia) and the information message of the Ministry of Economic Development of Russia. It will remain in effect after January 1, 2014. It includes the following electronic platforms:

The procedure for conducting electronic auctions on these sites must comply with the rules established (Part 10, Article 112 of the Law of April 5, 2013 No. 44-FZ).

Conditions

An auction in electronic form is required if the subject of purchase is included in a special list approved by Order of the Government of the Russian Federation dated October 31, 2013 No. 2019-r, or in additional lists adopted at the regional level. However, regardless of whether goods (works, services) are included in the list or not, the customer can also conduct a request for quotation, request for proposals or purchase from a single supplier (subject to the restrictions established by the Law of April 5, 2013 No. 44-FZ) .*

The customer can hold an auction electronically for any contract amount. The legislation does not contain any restrictions in this regard.*

Attention: FAS Russia may bring the customer's officials (for example, the manager) to administrative liability and fine them in the amount of 50,000 rubles. for the incorrect choice of the method for determining the supplier of goods (works, services) included in the lists approved by the Government of the Russian Federation or constituent entities of the Russian Federation (Part 2 of Article 7.29 of the Code of Administrative Offenses of the Russian Federation).

Auction procedure

Determination of a supplier (contractor, performer) using an electronic auction takes place in the following order:

  • consideration of the first parts of applications for participation in the electronic auction;
  • consideration of the second parts of applications for participation in the electronic auction.*

Preparation for the event

The decision to hold an auction is made by the customer, and in case of centralization of procurement - by an authorized body or an authorized institution (Part 5 of Article 24, Article 26 of the Law of April 5, 2013 No. 44-FZ).

Before holding an electronic auction, create a procurement commission. In this case, the customer has the right to create both a specialized auction commission and a single commission authorized to determine the supplier by any means (Article 39 of the Law of April 5, 2013 No. 44-FZ).*

Attention: if due to a technical failure on the official website (www.zakupki.gov.ru) it is impossible to publish information about the procurement, this must be done immediately after the site is restored to functionality.

Notice of electronic auction

If the initial contract price is above 3 million rubles, then the customer must place a notice of the electronic auction on the official website at least 15 days before the deadline for submitting applications. If the initial contract price does not exceed 3 million rubles, then notification is allowed at least seven days in advance. Such requirements are established by parts and Article 63 of the Law of April 5, 2013 No. 44-FZ.*

In addition to the official website, the customer or body authorized to conduct centralized procurement may publish a notice of the auction in any media (including electronic). But such a publication does not cancel its publication on the official website (Part 4 of Article 63 of the Law of April 5, 2013 No. 44-FZ).

The notice of an electronic auction must indicate:

  • address of an electronic platform on the Internet;
  • expiration date for filing applications for participation in the electronic auction;
  • date of the auction;
  • summary terms of the contract and characteristics of the goods supplied (scope of work performed, services provided);
  • amount of application security;
  • all restrictions established by law on participation in the selection of a supplier;

A complete list of data that must be included in a published notice is contained in Article 42 and Part 5 of Article 63 of the Law of April 5, 2013 No. 44-FZ.*

Changing the Auction Notice

The customer has the right to make changes to the notice of an electronic auction no later than two days before the deadline for submitting applications for participation in it. But information about the procurement object cannot be changed.

In this case, the deadline for submitting applications for participation must be extended if less than seven days remain from the date of changes on the site to the date of termination of applications.

Auction Documentation

Simultaneously with the publication of the auction notice, post all the necessary documentation on the official website. For example, a draft contract is part of such documentation (Part 4 of Article 64, Part 1 of Article 65 of the Law of April 5, 2013 No. 44-FZ). The posted documentation is provided with free and free access(Part 2 of Article 65 of the Law of April 5, 2013 No. 44-FZ).

The documentation must disclose all information regarding the procurement, in particular:

  • name and description of the subject of procurement and justification for the initial (maximum) contract price;
  • requirements for the content of an application for participation in an electronic auction and instructions for filling it out;
  • information about the currency of the contract price and settlements with suppliers (contractors, performers);
  • the amount and procedure for providing security for the performance of the contract;
  • information about the customer’s ability to make a decision on unilateral refusal to fulfill the contract.*

The full list of information that must be contained in the auction documentation is established by Part 1 of Article 64 of the Law of April 5, 2013 No. 44-FZ. If an institution needs to conclude an energy service contract, additionally reflect the information specified in parts and Article 108 of the Law of April 5, 2013 No. 44-FZ.

Attention: the government of the Russian Federation has the right to determine a special procedure for any procurement of goods, work or services (Part 1 of Article 111 of the Law of April 5, 2013 No. 44-FZ).

There are a number of conditions that the auction organizer does not have the right to include in the documentation. For example, this is a requirement for the business reputation of participants, their production capacity, technological equipment, etc. This is stated in Part 3 of Article 33 of the Law of April 5, 2013 No. 44-FZ. In addition, the auction documentation should not contain conditions that may entail a limitation on the number of procurement participants, as well as requirements for the form and procedure for filling out an application for participation in an electronic auction. This procedure is established by paragraph 2 of part 1, part 2 of Article 64 of the Law of April 5, 2013 No. 44-FZ.

Changing auction documentation

The customer has the right to make changes to the documentation about the electronic auction no later than two days before the deadline for submitting applications for participation in it.

If there are less than seven days left from the date the changes are posted on the official website until the application submission deadline, then the deadline for submitting applications for participation must be extended (so that at least seven days remain).

It is not allowed to change information about the procurement object and increase the amount of security for the application for participation.

This procedure is provided for in Part 6 of Article 65 of the Law of April 5, 2013 No. 44-FZ.

Accreditation of procurement participants

To obtain the accreditation required to participate in an electronic auction, the procurement participant submits the following documents and information to the operator of the electronic platform:

  • participant’s application for accreditation on the electronic platform;
  • copies of an extract from the Unified State Register of Legal Entities (for legal entities) or from the Unified State Register of Individual Entrepreneurs (for entrepreneurs), received no earlier than six months before the date of application for accreditation;
  • copies of the constituent documents of the procurement participant (or passport, if the participant is a citizen);
  • copies of documents confirming the person’s authority to obtain accreditation on behalf of the institution (for example, a decision to appoint a manager or a power of attorney);
  • TIN of the procurement participant;
  • a decision to approve a transaction that will be concluded based on the results of the auction (in the event that, according to the constituent documents, the participant does not have the right to enter into a transaction without this decision).*

The full list of documents and information that must be submitted to obtain accreditation is established by Part 2 of Article 61 of the Law of April 5, 2013 No. 44-FZ. It is not allowed to require any additional documents or information (Part 3 of Article 61 of the Law of April 5, 2013 No. 44-FZ).

Within five working days from receipt necessary documents and information, the operator of the electronic platform is obliged to:

  • make a decision on accreditation or refusal to accredit a procurement participant;
  • send the participant a notice of the decision.

Application for participation

An application to participate in an electronic auction can only be submitted by persons who have received accreditation on the electronic platform (Part 1 of Article 66 of the Law of April 5, 2013 No. 44-FZ).

An application for participation in an electronic auction consists of two parts, which are submitted simultaneously in the form of two electronic documents through an electronic platform (Part, Article 66 of the Law of April 5, 2013 No. 44-FZ).*

The first part of the application must contain the following information:

  • the participant’s consent to the supply of goods (performance of work, provision of services);
  • indication of trademark(its verbal designation) and specific indicators of the proposed equivalent product;
  • specific indicators of the offered goods corresponding to the values ​​​​established by the electronic auction documentation;
  • sketch, drawing, drawing, photograph or other image of the item being purchased.

A complete list of information that the first part of an application for participation in an electronic auction must contain is given in parts 3–4 of Article 66 of the Law of April 5, 2013 No. 44-FZ.

The second part of the application includes the following documents and information:

  • information about the participant (name, legal form, location, etc.);
  • documents confirming the applicant’s compliance with the conditions for admission to the auction (his competence to enter into a contract, absence of tax arrears, etc.);
  • documents confirming the right to receive benefits, or copies of these documents.

When accepting an application, the operator of the electronic platform, within one hour from the moment of its receipt, is obliged to block transactions on the participant’s account in the amount of security for the application for participation in an open auction. Also, the operator of the electronic platform must assign a serial number to the application and send confirmation of its receipt to the procurement participant in the form of an electronic document. This procedure is given in Part 18 of Article 44, Part 9 of Article 66 of the Law of April 5, 2013 No. 44-FZ.

Within one hour from the receipt of the application, the operator of the electronic platform must return the received application to the participant if:

  • funds in the amount of the application security are not in the account (opened for conducting operations to secure participation in electronic auctions);
  • one procurement participant has submitted two (or more) applications (provided that previously submitted applications have not been withdrawn).

A complete list of cases in which the operator of an electronic platform must return an application is given in Part 11 of Article 66 of the Law of April 5, 2013 No. 44-FZ.

When notifying a participant of the reasons for rejecting an application, the operator must indicate the provisions of the law on contract system in the field of procurement, which were violated. Returns of applications for participation in procurement for other reasons are not permitted. This is stated in Part 12 of Article 66 of the Law of April 5, 2013 No. 44-FZ.

Procedure for consideration of applications

The procedure for considering applications depends on their number.

If applications for participation in the auction were not submitted or only one application was submitted, the electronic auction is considered invalid (Part 16, Article 66 of the Law of April 5, 2013 No. 44-FZ).

Within three working days, the customer’s auction commission (or authorized body) checks the received documents for compliance with the requirements of the auction documentation and transmits to the operator of the electronic platform a protocol of its consideration of the single application, signed by the members of the commission. The operator, within one hour of receiving the protocol, sends the participant a notification of the commission’s decision. If a positive decision is made, the customer concludes with the only participant contract as with a single supplier. This conclusion follows from Part 1 of Part 5 of Art. 67 of the Law of April 5, 2013 No. 44-FZ).

The commission formalizes the results of consideration of the first parts of applications in a protocol, which must contain:

  • information about the serial numbers of applications for participation in the auction;
  • decision on the admission of the applicant to participate in the auction or

2. Concepts and abbreviations used in auction documentation

The concepts, terms and abbreviations used in this auction documentation are used in the meanings defined by the Federal Law - Federal Law “On placing orders for the supply of goods, performance of work, provision of services for state and municipal needs” (hereinafter referred to as the federal law).

The following terms and abbreviations are also used in this auction documentation:

- official site – All-Russian official website on the Internet for posting information on placing orders for the supply of goods, performance of work, provision of services, located at www . zakupki. gov. ru;

­­– open auction in electronic form – an open auction, the holding of which is provided by the operator of an electronic platform on a website on the Internet (hereinafter referred to as the auction);

- electronic platform - a website on the Internet where open auctions are held in electronic form;

- electronic platform operator - a legal entity, regardless of its organizational and legal form, form of ownership, location and place of origin of capital, or an individual as an individual entrepreneur, state registration which are carried out in the prescribed manner on the territory of the Russian Federation, which own the electronic platform, the software and hardware necessary for its operation and ensure the conduct of open auctions in electronic form in accordance with the legislation of the Russian Federation on the placement of orders;

- electronic digital signature (hereinafter referred to as EDS) details of an electronic document intended to protect this electronic document from forgery, obtained as a result of cryptographic transformation of information using a private key of an electronic digital signature and allowing to identify the owner of the signature key certificate, as well as to establish the absence of distortion of information in the electronic document;

- auction commission – A single commission approved by resolution of the administration of the municipal formation of the Priozersky municipal district of the Leningrad region No. 000 dated 01/01/01;

- municipal customer - administration of the municipal formation Priozersky municipal district of the Leningrad region (hereinafter referred to as the customer);

- application to participate in an open auction in electronic form (hereinafter referred to as the application) – an application for participation in the auction prepared by a participant in placing an order and submitted to the operator of the electronic platform in accordance with federal law;

- Contract – municipal contract;

- work – work performed for the needs of customers;

-participant(s) participant(s) placing the order. A participant in placing an order can be any legal entity, regardless of its organizational and legal form, form of ownership, location and place of origin of capital, or any individual, including an individual entrepreneur. Participants in placing orders have the right to act in relations related to placing orders for the supply of goods, performance of work, provision of services for the needs of customers, both directly and through their representatives. The powers of representatives of participants in placing an order are confirmed by a power of attorney issued and executed in accordance with civil law, or its notarized copy.

- auction participant – a procurement participant who submitted an application to participate in the auction and was admitted by the auction commission to participate in the auction based on the results of consideration of the first parts of the applications;

auction winner – the auction participant who offered the lowest contract price, and whose application for participation in the auction complies with the requirements of the auction documentation. This price cannot exceed the initial (maximum) contract price.

3. Information about the municipal customer

3.1.Customer information:

Municipal customer: administration of the municipal formation Priozersky municipal district of the Leningrad region.

4. General information about the auction

4.1.Order form– open auction in electronic form (hereinafter referred to as the auction).

4.2.Subject of contract: repair of the roof of the building MBOU "Sosnovskaya Secondary School".

Scope of work performed: in accordance with the types and volumes specified in the technical specifications (Appendix No. 1 to the auction documentation).

4.3.Initial (maximum) contract price, including all taxes and other obligatory payments: 1 One million four hundred thirty thousand) rubles 00 kopecks.

The contract price includes: the cost of work and construction materials paid by the Customer to the Contractor for the complete fulfillment by the Contractor of its obligations to fulfill the contract, including the cost necessary equipment and materials, costs for their delivery, unloading, payment of taxes (including VAT), fees and other obligatory payments, as well as warranty support.

The initial (maximum) contract price is set in accordance with Local Estimate No. 20-13-C attached to this documentation (Appendix to the auction documentation).

4.4.Currency, used in the formation of contract prices and settlements with suppliers, ruble.

4.5. Procedure for applying the official rate foreign currency to the ruble of the Russian Federation, established by the Central Bank of the Russian Federation and used when paying for the concluded contract: does not apply.

4.6.Source of financing - budget of the municipal formation Priozersky municipal district of the Leningrad region, regional budget.

4.7. Form, terms and procedure for payment for work: payment is made in rubles according to the terms of the contract concluded between the customer and the contractor. No advance payment is provided.

4.8. Requirements for the timing and (or) scope of providing quality guarantees: in accordance with the municipal contract.

4.9. Place of work: Leningrad region, Priozersky district, village. Sosnovo, st. Svyazi, house no. 13a.

4.10. WITH schedule of work: from the date of conclusion of the municipal contract until July 25, 2013.

4.11. Securing the application participation in the auction is set at 2% of the initial (maximum) price of the municipal contract, which is - ruble 00 kopecks.

4.12 Ensuring the execution of a municipal contractset to size: 20% of the initial (maximum) price of the municipal contract, which is rubles 00 kopecks.

The contract is concluded only after the participant of the open auction in electronic form with whom the contract is concluded provides security for the performance of the contract in the amount of security for the performance of the contract established by this documentation on the open auction in electronic form. The method of ensuring the execution of the contract from the methods specified in this part is determined by such participant in the open auction in electronic form independently.

4.12.1. The auction winner is obliged to provide the customer with security for the execution of the municipal contract in any way provided for by this documentation within the period established by Part 4 of Art. 41.12 of the Federal Law of January 1, 2001.

4.12.2. The procedure for providing security and requirements for security.

An irrevocable bank guarantee is issued by a bank or other credit institution. An irrevocable bank guarantee must comply with the requirements established by the legislation of the Russian Federation.

The validity period of the bank guarantee must cover the duration of the municipal contract.

4.12.2.2. Pledge of funds, including in the form of a contribution (deposit).

The participant transfers the amount Money specified in clause 4.12., using the following details:

In the purpose of payment, indicate: targeted funds to ensure the execution of the contract (indicate the name of the auction in accordance with the auction documentation).

The funds transferred to the customer as collateral remain in the customer’s account during the term of the contract.

4.13. If the participant in an open auction in electronic form with whom the contract is concluded is state-financed organization, providing security for the performance of the contract is not required.

4.14. If for any reason the contract security has ceased to be valid, has expired or otherwise ceased to ensure the fulfillment by the contractor of its obligations under the contract, the relevant contractor undertakes to provide the customer with another (new) appropriate security for the fulfillment of obligations under the contract within ten banking days on the same conditions and in the same amount as specified in this auction documentation.

5. Dates and times of the main stages of the auction

5.1. Date and time of the deadline for submitting applications for participation in the auction: May 282013, 10-00 Moscow time.

5.2. Expiration date for consideration of the first parts of applications for participation in the auction: May 292013.

5.3. Auction date: June 3, 2013.

6. Amendments to the auction documentation and cancellation of the auction

6.1. Municipal customer for own initiative or in accordance with a received request for clarification of the provisions of the documentation on an open auction in electronic form, has the right to make a decision to make changes to the documentation on an open auction no later than five days before the deadline for filing applications for participation in an open auction in electronic form. Changing the subject of an open auction in electronic form is not allowed. Within one day from the date of acceptance said decision changes made to the auction documentation are posted by the municipal customer on the official website. In this case, the deadline for submitting applications for participation in the auction must be extended so that from the date of posting such changes to the closing date for submitting applications for participation in the open auction, this period is at least seven days.

6.2. The municipal customer has the right to refuse to hold an auction in electronic form no later than five days before the deadline for filing applications for participation in an open auction in electronic form. The municipal customer, within one day from the date of the decision to refuse to hold an open auction, places a notice of refusal to hold an open auction on the official website. The operator of the electronic platform, within one working day from the date of posting on the official website of the notice of refusal to hold an open auction, stops blocking transactions carried out in accordance with federal law on the account of the order placement participant for carrying out operations to ensure participation in open auctions in electronic form in relation to monetary funds in the amount of security for an application for participation in an open auction.

7. Requirements for the content and composition of the application for participation in the auction

The application for participation in the auction consists of two parts.

7.1. The first part of the application for participation in the auction must contain the following information:

consent of the order placement participant to perform work on the terms provided for in the open auction documentation in electronic form;

7.2. The second part of the application for participation in the auction must contain the following documents and information:

1) company name (title), information about the organizational and legal form, location, postal address (for a legal entity), last name, first name, patronymic, passport details, information about place of residence (for individual), contact telephone number, taxpayer identification number;

2) a decision on approval or on the completion of a major transaction or a copy of such a decision if the requirement for the need for such a decision to carry out a major transaction is established by the legislation of the Russian Federation and (or) the constituent documents of a legal entity and if for a participant in placing an order for the supply of goods, execution works, provision of services that are the subject of the contract, or the contribution of funds as security for an application for participation in an auction, securing the execution of a contract are a major transaction. Providing this decision is not required if the initial (maximum) price of the contract does not exceed the maximum transaction amount provided for by the decision on approval or execution of transactions provided for the accreditation of a participant in placing an order on an electronic platform.

8. Instructions for filling out an application for participation in the auction

A participant in placing an order has the right to submit only one application for participation in the auction.

A participant in placing an order has the right to submit an application for participation in the auction at any time from the moment the notice of the auction is posted on the website until the date and time of the deadline for submitting applications for participation in the auction provided for in the auction documentation.

An application for participation in the auction is drawn up taking into account the requirements of clause 7 and is sent by the participant in placing the order to the operator of the electronic platform in the form of two electronic documents. The specified electronic documents are submitted simultaneously.

The language of the application for participation in the auction is Russian.

9. Requirements for Participants

The ordering participant must meet the following requirements:

9.1. Failure to liquidate the procurement participant - a legal entity and the absence of a decision of the arbitration court to declare the procurement participant - a legal entity, individual entrepreneur bankrupt and to open bankruptcy proceedings.

9.2. Failure to suspend the activities of a procurement participant in the manner prescribed Code of the Russian Federation on Administrative Offenses, on the day of filing an application for participation in the auction.

9.3. ABOUT the procurement participant has no debt on accrued taxes, fees and other obligatory payments to budgets of any level or state extra-budgetary funds for the past calendar year, the amount of which exceeds twenty-five percent of the book value of the procurement participant’s assets according to the financial statements for the last completed reporting period. A participant in placing an order is considered to comply with the established requirement if he appeals the existence of the specified debt in accordance with the legislation of the Russian Federation and a decision on such a complaint has not been made on the day of consideration of the application for participation in the auction.

9.4. Absence of information about the participant in the register of unscrupulous suppliers.

10. Review by the Unified Commission of applications from procurement participants and the grounds for rejecting such applications

10.1. The Unified Commission considers the first parts of applications for participation in an open auction in accordance with Art. 41.9.

10.1.1. A participant in placing an order is not allowed to participate in an open auction in electronic form if:

1) failure to provide information provided for in clause 7.1 clause 7 of this auction documentation or provision of false information;

2) discrepancies between the information provided for in clause 7.1 clause 7 of this auction documentation and the requirements of the auction documentation.

10.2. The Unified Commission considers the second parts of applications for participation in an open auction in accordance with Art. 41.11.

10.2.1. An application for participation in an open auction in electronic form is recognized as not meeting the requirements established by the documentation for an open auction in electronic form in the following cases:

1) failure to submit documents specified in clause 7.2 clause 7 of this documentation, taking into account documents previously submitted as part of the first parts of applications for participation in an open auction, absence of documents provided for in clauses 1, 3-5, 7 and , or their non-compliance with the requirements documentation about an open auction, as well as the presence in such documents of inaccurate information about the participant in the order placement. Lack of documents provided for in paragraphs 1, 3-5, 7 and 8 part 2 article 41.4 of the Federal Law, or their non-compliance with the requirements of the open auction documentation, as well as the presence in such documents of unreliable information about the procurement participant is determined as of the date and time of the deadline for filing applications for participation in the open auction. In this case, an application for participation in an open auction cannot be recognized as not meeting the requirements established by the documentation for an open auction, based on receipt of an Extract from the Unified state register legal entities (Unified State Register individual entrepreneurs) more than six months before the deadline for filing applications for participation in an open auction;

2) non-compliance of the procurement participant with the requirements established in accordance with Article 11 of the Federal Law.

11. The right of the customer during the execution of the contract to change the contract price without changing the scope of work provided for in the contract

11.1. The contract price may be reduced by agreement of the parties without changing the scope of work provided for in the contract and other conditions for the execution of the contract.

12. Procedure for concluding a municipal contract

12.1. The contract is concluded on the terms specified in the auction documentation, at the price offered by the auction winner.

The customer, within five days from the date of posting on the electronic platform the protocol for summing up the results of the open auction, sends to the operator of the electronic platform, without the customer’s signature, a draft contract, which is drawn up by including the contract price proposed by the participant in the open auction with whom the contract is concluded in the draft contract attached to the documentation about an open auction in electronic form.

The customer calculates the coefficient of reduction of the initial (maximum) contract price to the contract price proposed by the winner during the bidding. The final contract price is recalculated taking into account the specified coefficient. If the contract provides for several stages of its execution, the final cost of each stage will be recalculated using the specified coefficient, that is, the final cost of each stage of the work is calculated in proportion to the reduction factor of the initial (maximum) contract price obtained during the bidding. The resulting final cost of the contract implementation stages and the total final price of the contract are included in the draft contract sent to the winning bidder. In this case, the total final price of the contract must correspond to the contract price proposal of the winning bidder.

The contract concluded based on the results of the bidding must contain the entire scope of work established by the customer, as well as the final price of the contract (the total cost of the stages of the contract), determined in the above manner based on the results of the bidding. At the same time, the cost of payment for the execution of work established in the contract does not correlate with the actual costs of the winning bidder for the execution specific works and is the obligation of the customer to pay for the contract (stages of contract implementation) in the established amount if it is properly performed.
