The first instance has already put an end to one of the disputes - the Sverdlovsk arbitration court decided that "Uralskiye dumplings". But this is only the first instance and it is possible that its decision will be appealed.

Tomorrow, the Arbitration Court will continue the proceedings on another claim: "Uralskie dumplings" demand from the company First Hand Media (owned by Sergei Netievsky) to return the rights to the show's trademark. We talked with Sergei Netievsky and listened to his version of what was happening.

- Your lawyers said that in the summer of last year some kind of conflict arose in Uralskiye Dumplings. What was the reason for it? class = "_">

- Indeed, we had different opinions about where to move the show next. I think every project needs to be updated. Since 2009, as a producer who brought the show "Ural dumplings" to STS, I have been constantly engaged in the formation and updating of the project: graphics, scenery, shooting techniques, editing and so on, to make it relevant and modern.

A loud conflict in "Uralskiye dumplings" broke out more than 20 years after the creation of the collective.

I had different proposals for "Dumplings" for development. For example, for everyone to do their own project, or to do a project with young comedians, who, to begin with, introduce them into our show, make documentaries and feature films. But the guys did not accept these ideas, and we had creative and organizational differences.

- Can you decipher what you call "creative differences"? class = "_">

- We have always discussed development issues with the whole team. As a result, we decided to take a break, tried to discuss our differences, and in the spring I learned about the first lawsuits.

- Sergei Isaev, when they announced the breakdown of relations with you in the fall, insisted that you were very busy with your projects in Moscow. class = "_">

- I really have projects that I have long dreamed of realizing. And during this pause, I began to make them more active. But I have always been involved in both "Ural dumplings" and my own projects.

- I was told that the differences were not only creative, but also financial. class = "_">

- Of course, where there is television creativity, there is also finance.

- Do you know Alexey Lyutikov, who runs the Uralskiye Pelmeni Production company? class = "_">

- Yes, I do. He joined me at First Hand Media in 2014 as an executive producer. And I entrusted him with the production of the show "Ural dumplings", taught and showed how and what to do, shared the secrets and experience of creating the show, which was accumulated over five years. He was with the company until the fall of 2015. But then we had disagreements with him, as I was not satisfied with the quality of his work on the creation of the new project "Fathers and These".

- They say that it was Alexey Lyutikov who became the starting mechanism of the conflict. Allegedly, he persuaded Sergei Isaev and other members of the team to produce the show without you. This is true? class = "_">

- It is clear that for 20 years we have had a lot of disputes in our team. And Alexey Lyutikov could theoretically strengthen these differences and offer himself as a new producer of the Uralskiye Dumplings show. Moreover, he learned from the inside how the show is made.

- Next Thursday, the Moscow Arbitration Court will consider the claim of Uralskiye Dumplings against your company First Hand Media: they demand to take away the show's trademark. As far as I understand, there is a text trademark, and there is a graphic one. class = "_">

- You are legally savvy. Indeed, there is a text and there is a graphic trademark. In 2015, lawyers and management of companies producing shows (First Hand Media and Idea Fix Media) initiated a technical procedure for combining signs.

Sergei Isaev (pictured on the left) is now actually in charge of Uralskiye Dumplings, but de jure the director is Sergei Netievsky.

The fact is that since 2012, the graphic logo "Uralskie dumplings", developed by First Hand Media, has been used on television broadcasts and at concerts. And it was not protected in any way, it was not registered with Rospatent. The production company has combined these two signs to remove risks in relation to the channel and to other partners.

- There is an opinion that when you left "Dumplings", you simply took it and took the trademark at the same time. class = "_">

- Commoners may think so. But we do not use this sign in any way, we do not prevent the team from doing shows and touring. The most important thing is that as soon as a dispute over a trademark arose, First Hand Media was ready to transfer this trademark to the team. We have offered this several times both to the representatives of the collective and directly to the team. But they don't want to take the sign! Instead, they go to court.

- When did First Hand Media register it? class = "_">

- I'm afraid to be mistaken, it was last November.

- Are you ready to transfer for free or for some kind of financial compensation? class = "_">

- First Hand Media is ready to transfer it completely free of charge.

- Earlier, the team's lawyers said that the Uralskiye Pelmeni trademark was worth 400 million rubles. class = "_">

- This figure is taken from the ceiling. It is not clear what this report is based on. As far as I know, a meeting of the "Russian Society of Appraisers" took place, which admitted that the report referred to by the team's lawyers had been made with significant violations. I think that on July 14 the court will sort out this issue.

Interestingly, Yulia Mikhalkova is not among the co-owners of Uralskiye Dumplings.

- Why did you decide to demand that you reinstate yourself in the position of director, if your relationship is still on pause? class = "_">

- In order to resolve the differences that have arisen. There are legal issues: if people leave, then you need to do it in a civilized manner.

- You have been with Pelmeny since 1994, and since 1998 you have been the team director. It is clear that the team has been renewed during this time. But now you are outside the project. Is this story closed to you? class = "_">

- No, the question is open. We have disputes, but this does not mean that we are enemies, enemies. It so happens that time passes and disputes go aside.

- It seems to me that it is difficult to come back after litigation. class = "_">

- Have you watched new episodes of the show after leaving Uralskiye Dumplings? class = "_">

- Honestly, not all. To some extent, the show began to differ from what we did before. But the project is popular, people are watching it, and I wish the guys success so that "Pelmeni" will develop further.

- For First Hand Media, Uralskiye Pelmeni, how significant was the project from a financial point of view? class = "_">

- I won't tell you in percentage. Essential. But we have been and are doing not only "Dumplings". For example, we made a mini-series "The Seasons of Love" for the "Domashny" TV channel, we are preparing for the production of the full-length comedy "March 9", and we are actively developing the "League of Improvisations" project.

- I understand that in September the "League of improvisations" will be held in Yekaterinburg. What is the highlight of this show? Why should it take off? class = "_">

- We want to gather all the teams that are engaged in improvisation in Yekaterinburg. Conduct master classes and trainings for them. And as a result, the best will become participants in the gala concert and will be invited to Moscow to shoot in October.

The Improvisation League is a short form theatrical improvisation competition. We take the themes of the games from the audience, set the rules of the game and make humorous numbers. This is a complete improvisation. And, as in any competition, the teams receive marks. In addition to the Ural teams, the winners of the "League of Improvisations" of 2015 will arrive, and there will be a real battle.

- Will this show appear on any of the TV channels? class = "_">

- We are currently negotiating with several channels. We think it will be an hour show. This is a completely new project for our television. There is a feeling that this project should work out.

For a long time, the former director fought to restore his rights and, judging by the latest news, Sergei Netievsky won a lawsuit against the team. He was fully reinstated in his rights as director.

Obviously, the trial had a negative impact on the relationship between the director and the team, so Sergei decided to leave of his own free will and leave the trademark to the team. Unfortunately, for some reason, the team did not find this enough, and in February 2017 a new lawsuit began against the former director. This time he was accused of illegal use of a trademark, which he gave away at will. Sergei did not tolerate such an attitude and filed a counterclaim, in which he asked the court to recover moral damage from the team, the costs of conducting the trial in the amount of more than 700 thousand rubles.

As expected, this time the court again sided with the defendant, but decided to satisfy the counterclaim only partially. As a result, instead of suing the former director for 400 million rubles, not very friendly colleagues have to pay him 300 thousand rubles themselves.

After a long trial, the successful showman continues to live with his family in Moscow on a permanent basis. The man's family, as far as we know, lives with him and supports him in all his endeavors.

Sergei Netievsky is a talented comedian and a person who has put a lot of effort into the development and formation of the Uralskiye Pelmeni show. Moreover, thanks to his efforts, the team went outside the KVN gates and became federal. And after Sergei took over as director, he was able to conclude a long-term contract with STS for filming and showing performances.

First version

Netievsky had to leave the Pelmeni team due to the fact that "his own shirt is closer." Sergey realized that his own well-being is much more important than the team's money. Therefore, he simply left the project, leaving his friends “in free float”.

Sergey switched to producing television series and other projects, so he did not want to waste his personal time on the show - there is no interest, there is no such profit.

This is the version that was voiced by some of the participants in the Ural Dumplings, but Sergei Aleksandrovich himself does not agree with it. Sergei told a completely different story, radically different from the first. In support of his version, it can be noted that he was backed up by two-year litigation.

Second version

According to this version, presented to the public by Sergei himself, at first he did not know at all that he had left the project. Yes, it happens. As it turned out, the team members had long looked askance at their friend, who was the director. Most of the team was confident that Sergei not only paid poorly for their work and labor, but also took all the money for himself. There were also claims that Sergei began to spend too much time in other projects, throwing his own show.

After some time, the team simply got together and wrote a class action lawsuit, in which there was a request to remove the director of the UE from their position. Naturally, no one began to warn Netievsky about this / But Sergei, upon learning about this, filed an appeal, and it was accepted in 2016. Then the team filed another claim, and Netievsky filed a counter.

After the trials were over, Sergei was nevertheless reinstated in the director's position, and the class action lawsuit was declared illegal. But why then did Sergey leave? No wonder - after all the events it would have been difficult to just forget the sidelong glances and the class action lawsuit, and the old Ural friendship was gone. Therefore, Sergei transferred the affairs to Isaev and wrote a letter of resignation at his own request.

Where is Sergey now and what is he doing?

At the moment, the former director of the comedy show still lives in the gold-domed with his family. Sergey owns his production studio Idea Fix Media. The main activity of the studio is producing television series.

He said that Netievsky had been selling recordings of Uralskiye Dumplings concerts to TV channels since 2009, leaving all the proceeds to himself. As Dmitry Sokolov added, at the time the creative team signed an agreement with STS on recording the show, Seregey Netievsky continued to hide the real income from the team.

“We already had suspicions. Once on the set we had a conversation with a representative of STS, during which we realized that there was money in this business. After that we arranged a meeting at our creative base and asked Netievsky to come with all the contracts and accounting documents. At the meeting, it became clear that our friend was embezzling our income from television activities. Netievsky had to admit everything, "said the artist, noting that when Sergei Netievsky was organizing the tour of the Ural Dumplings, he also hid real income from the team members:

“After that, we deprived him of the right to go on tour. In general, there were always hints that something was unclean. He considers his actions to be legitimate! According to Dmitry Brekotkin, the team proposed to resolve this issue out of court, but Netievsky did not go to the world.

As he wrote, the conflict between "Uralskiye dumplings" and Sergei Netievsky has been going on for quite a long time. In the fall of 2015, the team decided to remove him from the director's position, but Netievsky challenged this in court and won the case. He noticed that each of the team members made his own contribution to the development of this show, including financial, and Netievsky decided that all the merits belong to him. In an interview with Internet publications, the ex-director of Uralskiye Dumplings, Sergei Netievsky, calls the accusations against him of theft "black PR".

He explains that all the financial issues that arose after he left the Uralskiye Pelmeni TV show had been resolved earlier in court. He also noted that this is not the first charge and a year ago the court acquitted him and ordered the prosecutors to pay him compensation.

Sergei Netievsky hopes that Isaev's morals and personal enmity will not prevent him from continuing negotiations on peaceful settlement of issues with the captain of the Ural dumplings, Andrei Rozhkov. He also noted that he will deal with the slander in his address himself. At the same time, he believes that the show they have created should continue to function in the same form as it is now. “Someday we will joke and laugh at all this together,” he summed up.
